New non-hosted short-term rentals are prohibited outside the Coastal Zone as of February 10, 2024, while the city page currently allows STRs throughout the Coastal Zone. This page explains the pending Local Coastal Plan amendment restrictions, the ADU and JADU rule, permit exceptions, the TOT certificate, fees, annual renewal, and the hosted affidavit. BnBGenius answers guest messages on Airbnb and VRBO 24/7. You verify the permit path and tax information, while local people handle site work.
The city states the current rule for new non-hosted rentals this way:
“New non-hosted STRs are prohibited outside of the Coastal Zone as of February 10, 2024.”
Source: New non-hosted prohibition
What this means for you: New non-hosted rentals are banned outside the Coastal Zone. The ban took effect on February 10, 2024. The Coastal Zone is treated differently under current rules.
What Is Restricted in Oceanside
Oceanside splits rentals into hosted and non-hosted types:
“A Hosted STR is a dwelling where the owner occupies the dwelling unit as his or her principal residence and offers a portion of the dwelling unit for short term rental while remaining on site.”
Source: Hosted definition
“A Non-Hosted STR (Unhosted) is a dwelling unit where the owner of the property does not occupy the dwelling unit as his or her principal residence or does not remain on site during rentals.”
Source: Non-hosted definition
What this means for you: A hosted rental means you occupy the home as your main residence. You rent only a portion of the dwelling unit. You also remain on site during the rental. A non-hosted rental means you do not occupy it as your main residence. Or you do not remain on site during rentals.
The city also bans short-term rentals in two property situations:
“STRs are prohibited in mobile home parks.”
Source: Mobile-home prohibition
“STRs are prohibited at non-conforming panhandle lots. A non-conforming panhandle lot is a lot that does not meet city standards set forth in Oceanside Zoning Ordinance Section 1050 (Y) or other applicable city ordinances.”
What this means for you: Short-term rentals are not allowed in mobile home parks. Short-term rentals are also banned at non-conforming panhandle lots. Those lots fail standards in Zoning Ordinance Section 1050(Y). They can also fail other applicable city ordinances instead.
The city page describes the current Coastal Zone status and a pending amendment:
“STRs are currently allowed throughout the Coastal Zone; however, the amendment approved by City Council and awaiting Local Coastal Plan (LCPA24-00001) approval would introduce the following restrictions:”
What this means for you: STRs are allowed throughout the Coastal Zone today. City Council approved an amendment that is still pending. It awaits Local Coastal Plan approval under LCPA24-00001. It is not an effective rule right now.
The pending amendment would add these restrictions:
“A maximum of 480 non-hosted STR Permits in residential zoning districts west of Coast Highway (not including the R-1 zone).”
Source: Pending permit cap
“Prohibit new non-hosted STRs in the R-1 zone.”
Source: Pending R-1 restriction
What this means for you: The cap of 480 permits is only proposed, not current. It would cover non-hosted permits in residential zoning districts. Those districts would sit west of Coast Highway. The R-1 zone would be excluded from that cap. New non-hosted rentals in R-1 would be banned. Both restrictions await Local Coastal Plan approval under LCPA24-00001. Until that approval happens, they are not current rules.
The city also restricts properties with accessory units:
“STRs are prohibited at properties with an Accessory Dwelling Unit (ADU) or Junior Accessory Dwelling Unit (JADU) that was permitted on or after September 9, 2017, neither the ADU, JADU, nor the primary residence can be used as an STR per Oceanside Zoning Ordinance 3006(E)(3).”
What this means for you: An ADU or JADU permitted on or after September 9, 2017 triggers this. The ADU, the JADU, and the primary residence are affected. None of those three can be used as an STR. Check the permit date before planning any rental.
Two more eligibility rules apply:
“Tenants of properties are not eligible to offer the property for STR.”
Source: Tenant eligibility
“STR Permits are non-transferable.”
Source: Permit transfer rule
What this means for you: Tenants of a property cannot offer it as an STR. STR permits are non-transferable under the city rule.
The city points to its code and to private rules:
“The City’s rules for operating a STR are set forth in Chapter 24 and Chapter 34, Article III of the Oceanside City Code and property owners and their agents should familiarize themselves with the applicable regulations. Property owners should consult with their Homeowners’ Association to determine if applicable CC&R’s provide additional regulations. The City does not enforce private CC&R’s.”
Source: Rules and CC&R caveat
What this means for you: The city rules sit in Chapter 24 and Chapter 34, Article III. Owners and their agents should read the applicable regulations there. Owners should also consult their Homeowners’ Association about CC&Rs. Those private CC&Rs may add more private rules. The city does not enforce those private CC&Rs.
How to Check Your Address and Permit Path
Make 3 checks before you spend money or time. First, confirm whether your property is in the Coastal Zone or outside it. The February 10, 2024 rule bans only new non-hosted STRs. Second, confirm whether the ADU and JADU rule affects your unit or primary residence. That rule covers units permitted on or after September 9, 2017. Third, check whether your intended path is a hosted Coastal unit or the gated HOA exception. The HOA exception needs at least 50 units, applicable parking compliance, and 24-hour security or on-site management. Also check the current permit requirement and its exceptions for your property. These are editorial checks, not a legal determination, and no outcome is promised.

What the City Requires Where Rentals Are Allowed
The city set a permit requirement with exceptions:
“An STR Permit is required for all STR properties as of June 7, 2024, unless:”
Source: Permit requirement
“The unit is part of a gated HOA that contains at least 50 units, meets applicable parking requirements, and has 24-hour security or on-site management.”
Source: Gated HOA exception
“The unit is a hosted unit in the Coastal Zone. However, the proposed amendment awaiting Local Coastal Plan approval would require all STR properties to obtain an STR Permit.”
Source: Hosted Coastal exception
What this means for you: An STR permit is required for all STR properties since June 7, 2024. The gated HOA exception needs at least 50 units in the HOA. It must also meet the applicable parking requirements. It needs 24-hour security or on-site management as well. A hosted unit in the Coastal Zone is currently excepted. The pending amendment would require permits for all STR properties. That proposal still awaits Local Coastal Plan approval today.
The process starts with a tax certificate:
“Before determining if a property requires an STR Permit the owner of the property will need to apply for a Transient Occupancy Tax (TOT) certificate.”
Source: TOT certificate before permit
“During the review of the TOT certificate application, Planning Staff will review the property and determine if an STR is permittable based on zoning and STR regulations.”
Source: Planning review
What this means for you: You apply for a TOT certificate before the city determines permit need. Planning Staff review the property during the TOT application. They decide if an STR is permittable from zoning and STR rules.
The city gives this path for owners without a valid TOT certificate:
“If you do not hold a valid TOT certificate and want to offer your property as an STR, email [email protected] with the property address to begin account setup or apply online via the below link.”
Source: TOT application path
What this means for you: You lack a valid TOT certificate and want to offer the property. The property would be offered as an STR under this path. Email the city with the property address for account setup. You can also apply online through the city link.
For the STR permit itself, the city states:
“To apply for an STR Permit, send an email to [email protected] with the property address and a staff member will respond within 48 business hours to assist you with account set up or use the online STR application link below.”
Source: Permit application response
What this means for you: For the permit, email the city with the property address. Staff respond within 48 business hours to assist with setup. The online STR application link is another option.
Fees and renewal follow a set schedule:
“The STR Permit fee is $250 and will be charged when the application for STR Permit or STR permit renewal is submitted. STR Permits must be renewed annually. There is also a property inspection fee of $220 which will be charged at the initial STR permit application and at a minimum of every three years thereafter. Fees are non-refundable.”
Source: Permit and inspection fees
What this means for you: The permit fee is charged at application or renewal submission. Permits must be renewed every year under the city rule. The inspection fee applies at the initial permit application. It applies again at least every 3 years after that. All fees are non-refundable under the city rule.
Hosted properties have one more requirement:
“Hosted properties will require the property owner to sign an affidavit affirming the property is their primary residence and they remain on-site during rental periods.”
Source: Hosted affidavit
What this means for you: The owner of a hosted property must sign a form. The form affirms the home is their main residence. It also affirms they stay on site during rentals.
Taxes
Check current Oceanside TOT information and the TOT certificate process with the city before you list. The table below compares what 2 platforms state for Oceanside:
| Platform | City entry | Platform-stated collection |
|---|---|---|
| Airbnb | Oceanside | “Transient Occupancy Tax: 10% of the listing price including any cleaning fees, for reservations 30 nights and shorter.” (Source: Airbnb Oceanside TOT help) “Tourism Marketing District Assessment: 1.5-2.5% of the listing price including any cleaning fees, for reservations 30 nights and shorter. Tax rate is dependent on listing type. For detailed information, please visit the Oceanside Transient Occupancy Tax website.” (Source: Airbnb Oceanside Tourism Marketing District help) |
| Vrbo | City of Oceanside under 31 nights | “The City of Oceanside under 31 nights” (Source: Vrbo Oceanside tax table) |
The platforms also describe general tax responsibilities:
“Hosts may need to manually collect and remit other applicable taxes on their stay or experience price.”
Source: Airbnb general tax responsibility
“You’re also responsible for collecting and remitting lodging taxes when we’re not liable to do so.”
Source: Vrbo general tax responsibility
What this means for you: Airbnb states a 10% tax on the listing price. That price includes any cleaning fees in the base. It covers reservations of 30 nights or shorter only. Airbnb also states a district assessment of 1.5%–2.5%. It uses the same listing price base and night limit. Its exact rate depends on the listing type. Vrbo lists the City of Oceanside for stays under 31 nights. Vrbo gives no tax rate in that entry. Airbnb says hosts may need to collect other applicable taxes. Those hosts may need to remit them manually too. Both duties would be manual under that statement. They would apply to the stay or experience price. Vrbo says you collect and remit lodging taxes when it is not liable.
