Is Airbnb Legal in Carmel-by-the-Sea? Zoning Limits and Permit Paths

Share on:

Carmel-by-the-Sea prohibits short-term rentals in its single-family R-1 zoning district. Two permit types exist in the commercial and R-4 districts. This page explains the restrictions and permit paths with official city quotes.

You stay responsible for permits, taxes and city duties.

The city states its core zoning rule plainly.

“Short term rentals are prohibited in the single family (R-1) Zoning District . In the commercial and R-4 districts, we have two types of permits: Legal Non-conforming and Housing Incentive Permits.”

Source: R-1 zone prohibition and other permit types

What this means for you: Short-term rentals are banned in single-family R-1 zones. Commercial and R-4 districts offer two permit types. Check your zoning district before planning anything else.

What Is Restricted in Carmel-by-the-Sea

The city defines what counts as a transient rental.

“Transient Rental is defined as any residential unit that is occupied for the purposes of sleeping, lodging, or similar reasons for a period of less than 30 consecutive days in exchange for a fee or similar consideration. These units are required to pay transient occupancy tax and are classified as a Group R-1 occupancy if the site contains more than one transient rental unit.”

What this means for you: A residential unit occupied for sleeping, lodging or similar reasons counts. The stay must last less than 30 consecutive days. A fee or similar consideration must be charged. These units owe transient occupancy tax to the city. A site with more than one transient unit gets Group R-1 occupancy. That building classification differs from the banned R-1 zoning district.

The city also restricts its commercial districts.

“With the exception of lawfully permitted hotels, motels and transient rentals, transient lodging of residential dwellings for remuneration is prohibited in the CC, SC and RC districts.”

Source: Commercial district prohibition exceptions

What this means for you: Paid transient stays in homes are banned in CC districts. The ban also covers SC and RC districts. Lawfully permitted hotels, motels and transient rentals are exceptions. Ask the city if your property is lawfully permitted.

How to Check Your Address and Permit Path

Some older permits still exist and carry special rights.

“The Legal Nonconforming Permits are permits that were issued prior to the adoption of our ordinance (below). These permits do not expire and may be transferred to a new owner upon transfer of sale of the property (the permit runs with the land and may not move from one location to another).”

Source: Existing permits transfer with property

What this means for you: Legal nonconforming permits were issued before the ordinance was adopted. They do not expire over any period of time. They may transfer to a new owner upon property sale. The permit runs with the land and may not relocate.

The city sets a precise cutoff for these permits.

“Transient rental units permitted prior to the effective date of Ordinance 2019-03 are classified as a legal nonconforming use as defined in CMC 17.68.090 . Transient rental permits are allowed in perpetuity and the six-month abandonment provisions contained in Chapter 17.36 CMC shall not apply.”

What this means for you: Permits issued before Ordinance 2019-03 took effect qualify. Such units are classified as legal nonconforming use. That classification comes from city code CMC 17.68.090. These transient rental permits are allowed in perpetuity. The six-month abandonment rule in Chapter 17.36 does not apply.

What the City Requires Where Rentals Are Allowed

The housing incentive program trades new rental housing for a transient unit.

“Transient rental units are permitted in the CC, SC, RC and R-4 districts as an incentive for the creation of new rental housing units. One transient rental unit is permitted for the creation of three new rental units; one of the new units on the site shall be rented as “low income” and the second unit shall be rented as “moderate income” as defined in CMC 17.70.020 . The third rental unit may be rented at market rate.”

What this means for you: The CC, SC, RC and R-4 districts permit this incentive. One transient unit is permitted for three new rental units. One new unit must be rented as low income. The second unit must be rented as moderate income. Those income terms are defined in CMC 17.70.020. The third rental unit may be rented at market rate.

Density and unit size also apply.

“Rental units created through this incentive program are subject to the density provisions identified in CMC 17.14.030 . b. Two of the rental units must be a minimum of 650 square feet in size.”

What this means for you: Rental units created through this incentive follow density provisions in CMC 17.14.030. Two of the rental units must be at least 650 square feet.

The transient unit itself has a location rule.

“The transient rental may be located at the same site as the three new rental units, or elsewhere within the CC, SC, RC or R-4 district.”

Source: Housing incentive transient rental location

What this means for you: The transient rental may sit at the same site as the rentals. It may also sit elsewhere within CC, SC, RC or R-4 districts.

Incentive permits carry extra conditions.

“Transient rentals permitted as an incentive require the issuance of a conditional use permit, must be maintained at the original site of approval, and are not classified as legal nonconforming as defined in CMC 17.68.090 .”

Source: Conditional use permit and original site

What this means for you: These transient rentals require a city conditional use permit. They must stay at the original approval site. They are not classified as legal nonconforming under CMC 17.68.090.

Parking applies everywhere.

“Transient rentals require one off-street parking space per unit in all districts.”

Source: Off-street parking requirement

What this means for you: Each transient unit requires one off-street parking space. This requirement applies in all districts of the city. Confirm current applications and fees with the city before applying.

Taxes

The definition above already states transient rentals owe transient occupancy tax. Under that definition, the duty covers residential units used for sleeping, lodging or similar reasons. The stay must last less than 30 consecutive days. A fee or similar consideration must be charged. This page does not quote a verified current city TOT rate. The checked city program establishes the duty but not a current rate, tax base or filing deadline. Confirm the current rate, base and filing instructions with the city before taking bookings. This is an evidence limit, not a finding that no tax applies.

The checked Airbnb and Vrbo California tax lists show no Carmel-by-the-Sea entry. That absence does not prove either platform collects nothing at your address. The general owner responsibility rules still apply.

Platform Owner tax duty What to check
Airbnb “Hosts may need to manually collect and remit other applicable taxes on their stay or experience price.” (Source: Airbnb owner tax responsibility) “If we collect taxes for your area, you’ll see a tax collection setting on the page. If there isn’t a section for local tax collection under Taxes , we don’t automatically collect and pay on your behalf for that listing.” (Source: Airbnb listing tax setting check)
VRBO “You’re also responsible for collecting and remitting lodging taxes when we’re not liable to do so.” (Source: Vrbo owner tax responsibility) Confirm your listing’s tax settings and local duty.

What this means for you: Airbnb hosts may need to manually collect and remit other applicable taxes. Those taxes apply to the stay or experience price. Check for a local tax collection setting under Taxes. If that section is missing, Airbnb does not automatically collect and pay. That non-collection applies only to that listing on Airbnb. Vrbo owners collect and remit lodging taxes when Vrbo is not liable. Confirm your specific duty with the city before booking guests.
