On the city side, the owner must hold an issued Short-Term Lodging Unit License plus a City business license, the correct use permit and TOT registration before renting, offering or advertising (Laguna licensing)(Laguna Beach code 5.84.030). The owner also names a local contact with a telephone available 24/7 who can physically respond within 60 minutes if necessary (Laguna local response)(Laguna Beach code 25.23.030(G)(3)). The nuisance response plan also sets two calls, each within 60 minutes of the initial complaint: a return call to the complainant and, at a minimum, a call to the primary adult occupant (Laguna Beach code 5.84.070(A)(2))(Laguna Beach code 5.84.070(A)(4)).

A Week of Self-Managing Your Airbnb in Laguna Beach

A typical week of Airbnb management in Laguna Beach moves from paperwork to turnover. Vacation rental management in Laguna Beach also means keeping the city duties current, so these steps group them in a sensible order.

  1. Before seeking approval, check the zoning route. Short-term lodging is allowed in the LB/P, C-N, C-1 and CH-M districts and the CBD-1, CBD-2, CBD Central Bluffs, CBD Office and CBD Visitor Commercial districts of the Downtown Specific Plan, subject to an Administrative Use Permit, and in the SLV district subject to a Conditional Use Permit (Laguna Beach code 25.23.030(A)). A unit in R-1, R-2, R-3 or VC that was legally permitted before October 2020 may continue only as a legal nonconforming use under all of its conditions; see the existing-unit FAQ below for the full continuation requirements (Laguna Beach code 25.23.060). Confirm your property and proposed use with the City before applying.

  2. Before the first advertisement, finish every approval. The required license and permits must be in place before renting, offering to rent or advertising (Laguna licensing)(Laguna Beach code 5.84.030). Your listing must show the license number in the exact form “Laguna Beach License No. ____” in a readable font (Laguna Beach code 5.84.100(B)). Ads must also carry the separate City business license and use-permit numbers (Laguna Beach code 25.23.040(I)). Do not merge these into one number.

  3. Before arrival, set the occupancy and parking limits. Each unit license specifies the maximum overnight occupants and the maximum vehicles that can park at the property (Laguna Beach code 5.84.060). Vehicles are limited to the on-site parking spaces, and no overnight or daytime occupant vehicles may park on a street serving residential homes (Laguna Beach code 25.23.040(B)). Post a copy of the nuisance response plan in a conspicuous place inside the property (Laguna Beach code 5.84.100(I)). Guests must not create unreasonable noise or disturbances (Laguna Beach code 25.23.040(C)).

  4. During the stay, keep the response duties alive. The local contact must be able to physically respond within 60 minutes if necessary (Laguna Beach code 25.23.030(G)(3)). A return telephone call to the complainant within 60 minutes of the initial complaint counts as prompt (Laguna Beach code 5.84.070(A)(2)). A telephone call to the primary adult occupant within 60 minutes of the initial nuisance complaint is the minimum for timely corrective action (Laguna Beach code 5.84.070(A)(4)). These are three separate duties, not interchangeable ones. If the contact person or their information changes, the operator must notify the City within 24 hours (Laguna Beach code 25.23.040(F)).

  5. After checkout, run the turnover. Walk the property, restock supplies and log anything broken. The table above shows how cleaning and repair tasks and review requests are handled. Keep the records needed to determine TOT for three years (Laguna Beach code 5.05.130).

  6. Each quarter, file the tax return. The return is due on or before the last day of the month following the close of each calendar quarter, or the close of any shorter reporting period the tax administrator establishes, and the full tax collected is remitted when the return is filed (Laguna Beach code 5.05.070). A return is required even if the unit was not rented during the quarter (Laguna Beach code 25.23.040(N)).

  7. At the annual review and renewal, plan ahead. Each year the owner gives the license administrator written confirmation of compliance with all performance standards and the approved nuisance response plan, confirming the plan is current and accurate (Laguna Beach code 5.84.100(J)). A use permit runs a maximum of three years unless otherwise specifically authorized (Laguna Beach code 25.23.040(Q)). The unit license expires upon the use permit’s expiration or earlier termination, unless sooner revoked (Laguna Beach code 5.84.030(A)). The use permit must be renewed first; no lodging license renews automatically (Laguna Beach code 5.84.030(B)). File the updated renewal form and any applicable fee at least 30 days before license expiry; timely filing keeps the license effective until the decision, subject to the renewal provisions (Laguna Beach code 5.84.030(C)).

Laguna Beach Short-Term Rental Permit and Rules: Your Checklist

The Laguna Beach short-term rental permit question is really a set of distinct documents: an Administrative or Conditional Use Permit, a Short-Term Lodging Unit License, a City business license and TOT registration (Laguna licensing). Work through the ten items below before you list.

“For the purposes of this chapter, a return telephone call to a complainant within 60 minutes of the initial complaint shall be deemed “prompt.””

Source: Laguna Beach code 5.84.070(A)(2)

What this means for you: When a neighbor complains, someone must call that neighbor back within an hour of the first complaint.

“The owner shall cause a copy of the nuisance response plan to be posted in a conspicuous place within the property being rented or otherwise occupied.”

Source: Laguna Beach code 5.84.100(I)

What this means for you: Guests should be able to find the plan easily, for example by the front door or next to the house rules.

For the full licensing chapter, see the official rules. For zoning, see the use-permit provisions.

Laguna Beach Airbnb Taxes

  • Total rate: Collect a total of 14% in taxes and assessments on all rental revenue: 12% City Transient Occupancy Tax and 2% Laguna Beach Tourism Marketing District assessment (Laguna tax total).
  • Quarterly returns: File a quarterly TOT return even if no rentals occurred during the quarter (Laguna tax reports)(Laguna Beach code 25.23.040(N)).
  • Deadline and payment: The return is due on or before the last day of the month following the close of each calendar quarter, or the close of any shorter reporting period established by the tax administrator, and the full amount of tax collected is remitted when the return is filed (Laguna Beach code 5.05.070).
  • Records: Keep the records needed to determine the tax for three years (Laguna Beach code 5.05.130).

What Airbnb Management in Laguna Beach Costs When You Self-Manage

  • License, renewal and plan fees: All fees in the licensing chapter, including license and renewal application fees and nuisance response plan amendment fees, are established by the city council by resolution (Laguna Beach code 5.84.050). Ask the City for the current figures when you apply.
  • Home-share waiver: The Use Permit fees are waived for home-share units (Laguna Beach code 25.23.030(B)).
  • Surety bond: The bond carries a face amount of $1,500, issued by a responsible surety company in the form approved by the city attorney (Laguna Beach code 5.84.040(A)(3)). That is the bond’s face amount, not a cash fee or premium quote.
  • Insurance: The owner must maintain liability insurance of not less than $500,000 to cover injuries, damages, losses and other claims associated with the short-term lodging (Laguna Beach code 25.23.040(P)). The code sets the coverage floor, not your premium.
  • Local taxes: Budget 14% of all rental revenue, split as 12% City TOT and 2% LBTMD assessment (Laguna tax total).
  • Administrative fines: For a violation of the licensing chapter committed, caused or maintained by the owner, occupant, hosting platform or operator, the city may issue an administrative citation for each day of the violation. A first violation brings a $1,000 fine, a second within a 12-month period $3,000, and a third or subsequent within a 12-month period $5,000, which may trigger license suspension or revocation (Laguna Beach code 5.84.150(B)).

Your cleaning and repair arrangements are whatever you agree with your on-site person; no price is dictated here.

Your first 500 messages are free, with all features and no card; after that it is $10 a month no matter how many listings you have.

Voice Concierge is $30/month. It includes 20 resolved calls each month, then $0.35 per resolved call.

If you hire a management company instead, ask it for its own separate quote.

Laguna Beach Airbnb FAQ for Self-Managing Owners

Can I self-manage my rental in Laguna Beach? Yes. Self-managing still means you hold the required license, use permit, business license and TOT registration before renting, offering or advertising (Laguna licensing)(Laguna Beach code 5.84.030). You also need a contact available 24/7 who can physically respond within 60 minutes if necessary (Laguna Beach code 25.23.030(G)(3)). Messaging software does not exempt you from any of this.

Do I need a Laguna Beach short-term rental permit? You need an Administrative or Conditional Use Permit plus a Short-Term Lodging Unit License, a City business license and TOT registration (Laguna licensing). All of them must be in place before you rent, offer or advertise (Laguna Beach code 5.84.030).

What do the permits and license cost? License, renewal and response-plan amendment fees are set by council resolution, so ask the City for current figures (Laguna Beach code 5.84.050). Use Permit fees are waived for home-share units (Laguna Beach code 25.23.030(B)). The $1,500 surety bond is a face amount, not a fee (Laguna Beach code 5.84.040(A)(3)).

Where is a new rental allowed? In the LB/P, C-N, C-1 and CH-M districts and the CBD-1, CBD-2, CBD Central Bluffs, CBD Office and CBD Visitor Commercial districts of the Downtown Specific Plan with an Administrative Use Permit, and in SLV with a Conditional Use Permit (Laguna Beach code 25.23.030(A)). The caps are ceilings, not a promise of available space (Laguna Beach code 25.23.030(B)).

What about an existing residential unit? A unit in R-1, R-2, R-3 or VC that was legally permitted before October 2020 may continue as a legal nonconforming use only under the section 25.23.060 continuation requirements: it must meet the requirements set forth there, continuously maintain a business license, fully and timely comply with record-keeping and TOT collection and remittance, and comply with all other conditions of the previously approved permit (Laguna Beach code 25.23.060). That continuation right runs with the land but lapses if the use is abandoned or ceases for 12 or more consecutive months (Laguna Beach code 25.23.060(B-C)). The owner’s license does not transfer, and an ownership or organizational change requires a new license (Laguna Beach code 5.84.030(E)).

What counts as home sharing? Home sharing means a rental of 30 consecutive days or less where the host lives on-site for the entire stay and the visitor has non-exclusive shared use of the home in exchange for compensation (Laguna Beach code 25.23.020). An additional 165 home-share units are allowed in single-family, duplex and triplex dwellings in the permitted districts (Laguna Beach code 25.23.030(B)). The Use Permit fees are waived for these units (Laguna Beach code 25.23.030(B)).

Which taxes and returns apply? Collect 14% on all rental revenue: 12% City TOT and 2% LBTMD assessment (Laguna tax total). File a quarterly return even in a quarter with no rentals (Laguna Beach code 25.23.040(N)). The default deadline is the last day of the month after the quarter closes, unless the tax administrator sets a shorter reporting period (Laguna Beach code 5.05.070).

Do I have to live nearby or name a contact? The code requires a local contact whose telephone is available 24/7 and who can physically respond within 60 minutes if necessary (Laguna Beach code 25.23.030(G)(3)). A return call to the complainant within 60 minutes of the initial complaint counts as prompt (Laguna Beach code 5.84.070(A)(2)), and a call to the primary adult occupant within 60 minutes of the initial nuisance complaint is the minimum for corrective action (Laguna Beach code 5.84.070(A)(4)). If the contact person or information changes, the operator must tell the City within 24 hours (Laguna Beach code 25.23.040(F)).

What numbers and notices go in my listing and unit? Show the license number as “Laguna Beach License No. ____” in a readable font (Laguna Beach code 5.84.100(B)). Add the City business license and use-permit numbers to all print and online ads (Laguna Beach code 25.23.040(I)). Post the response plan conspicuously inside the property (Laguna Beach code 5.84.100(I)). New applications also require notice to residences and businesses within 200 feet at least 30 days before license issuance (Laguna notice).

When does renewal happen, and what if my license is revoked? The license expires upon the use permit’s expiration or earlier termination, unless sooner revoked (Laguna Beach code 5.84.030(A)), and the use permit must be renewed first, with no automatic renewal of the lodging license (Laguna Beach code 5.84.030(B)). Submit the updated form and any applicable fee at least 30 days before license expiry; timely filing keeps the license effective until the decision, subject to the use-permit-first rule and the license renewal provisions (Laguna Beach code 5.84.030(C)). After revocation, the owner must wait at least three years before applying for a new license for any property in the city (Laguna Beach code 5.84.150(E)). See the renewal checklist above for the full procedure.
